Terms of Service for VitaTag-SA

Welcome to VitaTag-SA, a service operated by MaruB Creations (Pty) Ltd ("we", "us", "our").
These Terms of Service ("Terms") govern your use of our dynamic NFC/QR Emergency Tags ("Tags") and the associated digital profile service (the "Service"). By purchasing a Tag or activating a profile, you ("you", "user") agree to these Terms.
1. The Service
VitaTag-SA provides a technology platform that allows users to store personal information (including name, emergency contacts, and medical data) on a secure digital profile. This profile can be accessed by third parties (such as first responders, paramedics, or members of the public) by scanning the QR code or tapping the NFC chip on a user's Tag.
2. User Accounts & Responsibilities
- Accuracy: You are solely responsible for the accuracy, completeness, and timeliness of the information you provide on your profile. We do not verify or endorse any user-submitted data. Inaccurate information (e.g., an old emergency contact or incorrect allergy) can have serious consequences.
- Activation: To use the Service, you must purchase a Tag and activate it using the provided link.
- Security: You are responsible for maintaining the physical security of your Tag. If your Tag is lost or stolen, you must contact us immediately to have it disabled.
3. Pricing & Subscriptions
We offer several products, all of which include a subscription to the Service.
- Initial Purchase: The one-time purchase price for a Tag (e.g., "VitaTag Card" at R250, "VitaTag Sticker" at R150, "Family 4-Pack" at R850) includes the first twelve (12) months of the Service subscription.
- Annual Renewal: After the initial 12-month period, your subscription to the Service will automatically expire unless renewed.
- Renewal Fee: The ongoing subscription fee is R100.00 (One Hundred Rand) per Tag, per year.
- Lapsed Subscription: If you fail to pay the renewal fee, your digital profile will be deactivated. Your data will be securely held for a grace period of 90 days, after which it may be permanently deleted from our servers.
4. User Consent (POPIA)
Our service requires the collection and processing of "Special Personal Information" (e.g., health data, data of children). By using the Service and agreeing to these Terms, you provide your explicit, voluntary, and informed consent for us to collect, store, and process this data for the sole purpose of providing the Service, as outlined in our Privacy Policy.
You further consent for this data to be accessed by any third party who physically scans or taps your Tag.
5. Limitation of Liability
MaruB Creations (Pty) Ltd provides this Service "as is". We are not a medical provider, an emergency service, or an insurer.
- We do not guarantee that your Tag will be scanned or that the information will be used by any third party.
- We are not liable for any damages, personal injury, or death arising from:
- Inaccurate or outdated information on your profile.
- The failure of a third party to scan or correctly interpret your profile.
- A lost or stolen Tag.
- Any temporary service outages due to internet failure or server maintenance.
Our total liability to you for any claim arising from the Service is limited to the total amount you have paid to us in the preceding 12 months.
6. Termination
You may stop using the Service at any time by requesting the deletion of your profile. We may terminate or suspend your access to the Service if you breach these Terms.
7. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
